1. Purpose

These Terms and Conditions of Sale (the “Terms”) govern the sale of photographic prints, reproductions, and original artworks (canvases, paintings) made through the online shop on the alunaya.co website, published by Jessica Alunaya (NEQ: 2276726702), whose full contact information appears in the Legal Notice. By placing an order, you agree to these Terms without reservation.

2. Products

The shop offers two types of products: Prints and reproductions: images printed in multiple copies, whether photographic prints or printed reproductions of an original painting, in the format and on the medium indicated on the product page. Original artworks (canvases, paintings): unique, handmade pieces. Each original artwork exists in a single copy only; once sold, it is no longer available. Colours and textures may vary slightly between the photo shown online and the product received (print or original artwork), due to differences in screen display and, for original artworks, their handmade nature.

3. Pricing

Prices are listed in Canadian dollars (CAD), including all applicable Quebec taxes where relevant. For orders shipped internationally, customs duties, import taxes, or administrative fees may apply upon arrival in your country: these fees are your sole responsibility and are neither calculated nor collected by Jessica Alunaya at the time of purchase. Shipping fees are calculated separately and displayed before final order confirmation.

4. Orders

Placing an order on the online shop constitutes acceptance of the prices and descriptions of the available products. An order confirmation is sent by email once payment has been validated. For original artworks, the order is only definitively confirmed once full payment has been received, as stock is limited to a single copy per artwork.

5. Payment

Payment is made at the time of ordering, by credit card, PayPal, or bank transfer, through the secure WooCommerce platform. No payment information is stored on the site’s servers.

6. Delivery

Two options are available: Shipping: products are carefully packaged (with reinforced protection for original artworks and framed prints) and shipped to the address provided when ordering. Delivery times vary by destination and are provided for information only; they are not guaranteed in the event of carrier or customs delays. In-person pickup: available in Montreal, by appointment, after confirmation by email. The risk of loss or damage transfers to the buyer once the package is handed over to the carrier, except where a packaging fault can be demonstrated.

7. Returns and Refunds

Prints and reproductions: you have 14 days from the date of receipt to request a return, provided the item is returned in its original, undamaged condition. Return shipping costs are your responsibility, unless the item received is defective or does not match the order. Refunds are issued within 14 days of receiving the returned item. Original artworks: given their unique nature, original artworks are sold as final sale and cannot be returned, except in the following two cases: the artwork arrived damaged during transport, or the artwork delivered does not match the one ordered. In these cases, contact us within 48 hours of receipt, with photos, to arrange a refund or replacement where possible. For any return request, write to jessica@alunaya.co.

8. Intellectual Property

The purchase of a print or an original artwork does not transfer any copyright or reproduction rights to the buyer. Jessica Alunaya retains full copyright over her creations, in accordance with the Copyright Act (R.S.C., 1985, c. C-42). Any reproduction, publication, or commercial use of the purchased artwork, other than private display, is prohibited without prior written consent.

9. Liability

Jessica Alunaya cannot be held responsible for delivery delays caused by the carrier or customs, nor for damage resulting from improper use or inadequate care of the artwork after receipt.

10. Personal Data

Information collected when placing an order is processed in accordance with the corresponding section of our Legal Notice.

11. Governing Law and Disputes

These Terms are governed by the laws applicable in the province of Quebec and the laws of Canada. Any dispute falls under the exclusive jurisdiction of the courts of the judicial district of Montreal, Quebec. The reference language for the resolution of any dispute is French.
